Section 23
Provisions relating to official or professional conduct
(1) A person holding a public position shall follow the prescribed official or professional conduct for the prescribed period from the date of his retirement for whatever reason.
(2) The official or professional conduct to be followed according to sub-section (1) shall be made by the following bodies or officers for the following officials: - (a) Judicial Council for judges
(b) Officials of constitutional bodies and related constitutional bodies for employees of such bodies (c) Government of Nepal, Council of Ministers for civil service employees (d) Supreme Court for civil servants working in courts,
(e) the Attorney General for the Public Prosecutor and the staff working in the Public Prosecutor's Office (f) For the head of the organized organization formed according to the prevailing law, by the relevant ministry and for other employees by the related organized organization
(g) Legislature-Parliament Secretariat Operations and Management Committee for the staff of the Parliament Secretariat
(h) By the designated officer for the person holding public office other than what is written in the above clauses.
(3) Notwithstanding anything written in clause (c) of sub-section (2), considering the nature of duties to be performed by an employee in a ministry or central agency or an agency under it, the official or professional conduct to be followed by such employee shall be determined by such ministry or central agency. The government of Nepal will be able to give authorization to make it.
(4) It shall be the duty of the concerned person to follow the official or professional conduct made in accordance with this section and the person who violates such conduct shall be subject to departmental action and records according to the amount of violation, if he is an employee, and if he is another official, the official who conducts official or professional conduct for him shall keep such records.
(5) Notwithstanding anything written in sub-section (4), if a person holding a public position does not comply with his official or professional conduct or violates any act which is considered an offense according to the prevailing law, there shall be no hindrance to take action in accordance with the relevant law.
